Did you have the iPhone on low power mode? I ‘believe’ that maybe disconnects it if you lock the screen. At least it used to.

Return definitely. Nothing you can do about it yourself without having to open up the entire phone which is a LOT of work. Best just to get a replacement.

You mentioned a phone with no battery but then talked about messages sending? I’m not sure which you want an answer for in that case. To be very clear though it’s absolutely impossible for a phone to be tracked if it has no battery or even if turned off. If turned off then the circuitry is under no power whatsoever and unlike the movies it would be absolutely impossible to track.
